Mr. Deus has been a member of the National Organization of Social Security Claimants’ Representatives (NOSSCR) for over thirty years and was one of the original members of the Fifth Circuit Organization of Social Security Claimants’ Representatives (FOSSCR). He has been on the board of directors of FOSSCR and has been a lecturer for both the bar association and FOSSCR. NOSSCR is an organization whose mission statement is “. . . to advocate for improvements in social security disability programs and to ensure that individuals with disabilities applying for social security disability and SSI benefits have access to highly qualified representation and receive fair decisions.” FOSSCR is an organization that focuses on education of social security representatives to ensure the highest quality representation for people with disabilities.

Am I Eligible For Social Security Disability?

There are different types of Social Security Disability programs with different requirements but for each you must be unable to work and your disability must be expected to last for over a year or end in death.

  • SSDI - Generally, for SSDI you must have earnings in 20 out of the last 40 quarters or roughly five out of the last ten years. These are known as work credits. Fewer work credits are required for people age 31 years or younger.
  • SSI - SSI does not require that you have worked in 20 out of the last 40 quarters, but it does have income and asset limits. Certain types of income like food stamps are not counted and certain assets are not counted. Examples of assets that are not counted include a house and land that you live on, one car and household goods and personal effects. There are other more obscure examples of assets that do not count.
  • Widows / Widowers Benefits - To be eligible for widows/widowers benefits you must be of the ages between 50 and 59, and have been married to a spouse who is deceased and had enough earnings over his/her lifetime. You must become disabled within seven years of the death of the spouse or within seven years after mother’s/father’s benefits based on the earnings of that spouse have ended. You must have been married for at least nine months. You can even receive widows/widowers benefits if you are divorced at the time of the death of a spouse if you were married for at least ten years.
If You Are 50 or Over

People of any age can apply for Social Security Disability Benefits but the rules change at age 50 and again at age 55 making it a little easier to win a social security disability case. Mr. Deus understands these rules and can apply them to help you win a social security case.
